When to File an EEOC Claim

You may need to involve the Washington state EEOC in your workplace sexual harassment or discrimination claim if your employer fails to resolve the problem internally. Most workplaces in Washington have policies in place for preventing and responding to civil rights infringements such as hostile work environments. Unfortunately, some employers do nothing in the face of sexual harassment and discrimination allegations.

If your employer does not respond appropriately to your complaint, take your case to the next step by filing an EEOC claim. The EEOC can step in when employees need assistance holding at-fault parties responsible for workplace harassment and/or discrimination. In 2018, the EEOC received 1,135 individual charges of unlawful discrimination in the State of Washington alone. How to File a Claim

If you want to file an EEOC claim, do so within 180 calendar days from the date of the last incident of harassment or discrimination. You will have 300 days if your state or county enforces a local law that prohibits the action in question. Do not miss your deadline, as this could mean the EEOC will not have the power to assist you. It is important to file with the EEOC before the time limit, as federal laws require you to go through the EEOC first before filing a lawsuit against your employer, except in cases involving the Equal Pay Act.

You may file an EEOC claim online, via mail or in person at a local agency office. The easiest way is through EEOC’s online portal. You can find answers to frequently asked questions and links to begin the process online. Follow the steps of filing a claim by describing the legal violation you suffered. The EEOC will get back to you for an interview. A trained staff member will discuss the issue with you and address your concerns through an official EEOC intervention. If filing a charge of harassment or discrimination claim is appropriate for your situation, the EEOC may make this recommendation.

What Comes Next?

After you file a charge with the EEOC, check its status online through the public portal. Within 10 days of bringing your charge, the EEOC will notify your employer. In some cases, the EEOC will proceed to mediation between you and your employer to try to resolve the issue. You may choose to hire an employment law attorney to go through the mediation process with you. It can take 10 months or longer for the EEOC to fully investigate a claim. If the EEOC’s efforts fail to remedy the situation or the Commission cannot verify a violation of the law, you will receive Notice of Right to Sue. Then you may file a claim in the Seattle courts for harassment or discrimination.
